Ms. Gilchrist called the meeting to order at 7:44PM and seated the members.Consideration of the Minutes

Library Lights.
Ms. Gilchrist said it is her understanding that the Library has not filed an application for outdoor lighting approval since they came for an informal discussion on 8/15/11 and yet they have installed some low canister lights and two lights in a tree by the entry way. Mrs. Boyer remarked that the last canister light is very visible from Route 47. Ms. Gilchrist took issue with the fact that they have gone ahead without any consultation with HDC. Mrs. Mills noted that Mr. Pleasants (at the informal discussion) had said they would put up something temporary and come back to the commission. Mrs. Boyer said the problem is that all the old lighting was taken out before they had permission to install any new lighting. Mr. Chute said the Library needs to come in with an application. All agreed. The members agreed that the Library is rightly concerned with the safety of their patrons, but they have made changes that are not part of a formal application. Ms. Gilchrist said she would write a letter asking them to come back.Walkway at Congregational Church.
The members looked at photos of the walkway taken recently by Mrs. Boyer, along with drawing #D100 by Halper Owens Architects submitted at the 4/18/11 meeting. Mr. Smith said the commission needs to point out to them that the plan included steps. Mrs. Mills said they should have notified HDC of the change. Ms. Gilchrist said she spoke with Mr. Werkhoven and he told her they did not need the steps after all. Mr. Hollinger pointed out that there is really no place for steps due to the slope. He said the Church should send the commission a letter for the record explaining why they made the change. The plan and the photos also show a pattern in the walkway rather than the stones being straight. Mr. Hollinger suggested maybe there is an engineering reason why they changed the pattern on the walkway due to the fact that the walk is on a grade and they are less likely to slip.Generators.
Ms. Gilchrist read from a notice written by Michael Ajello, ZEO to the Zoning Commission. In the notice Mr. Ajello stated that with the recent extended power outages it has become apparent that generators require open-air locations and he will suspend enforcement of the requirement that generators “be surrounded by a 6ft high stockade type fence or an equivalent sound deflecting structure.” Mrs. Boyer suggested the commission needs to discuss and decide what HDC means by “screening” and types of fencing which would be acceptable; lattice, picket, etc. Also, how much opening would be necessary to be safe because HDC is concerned with visibility from the road. The members discussed the possibility of meeting with Mr. Ajello at the January meeting.MOTION:

The members read the letter. Mrs. Boyer commented that there should be something in the letter about the applicant being required to come back to the commission if they are considering any changes to the C of A issued to them. After some discussion, it was decided to add a sentence to the letter that accompanies the C of A, stating deviations are not permitted. It was decided by the commission that in the future, all welcome letters will be sent out certified return receipt.Mr. Hollinger commented on the fact that in all of the historic districts there are two major construction sites and they are both on Calhoun Street. Mr. Smith agreed and said the commission members need to organize themselves and watch what people are doing. All agreed. Mrs. Boyer said photos of the districts need to be taken again. Mrs. Boyer asked a hypothetical question: If someone has a C of A with a violation – can HDC refuse to consider any additional C of A’s? In addition, can HDC hold up a Certificate of Occupancy from the Building Official until the violation is corrected?

White /6 Parsonage Lane /Extend Certificate of Appropriateness to build garage/studio addition
Ms. Gilchrist opened the Public Hearing at 7:35PM to consider the application for a Certificate of Appropriateness submitted by Zemma Mastin White, 6 Parsonage Lane, to extend an existing Certificate of Appropriateness to build a garage/studio addition. She read the legal notice which appeared in The Waterbury Republican on 12/7/11. Ms. Gilchrist seated the members and seated Alternate Krimsky for Mrs. Boyer. Mrs. White was present.Ms. Gilchrist stated that Mrs. White is present to request an extension of her Certificate of Appropriateness. She invited Mrs. White to speak to the commission. Mrs. White thanked the members for holding this special meeting. She explained that her case is still in the Appellate Court and they cannot start work on the addition until the case is settled. Mr. Smith asked if a one year extension will be long enough. Mrs. White replied she did not know since the next step would be the Supreme Court. Mr. Kerr commented that Mr. and Mrs. White have no choice; their hands are tied. After a brief discussion, the commissioners agreed that since the expiration on C of A’s has traditionally been one year, they would stay with a one year extension. Mrs. White said she does not mind coming back in another year if necessary.
Ms. Gilchrist asked the members if they had any additional questions or comments. There were none. There was no one else present to speak for or against this application. Ms. Gilchrist thanked Mrs. White for coming before the commission.

Ms. Gilchrist opened the Public Hearing at 7:35PM to consider the application for a Certificate of Appropriateness submitted by Brigitte Klein and Robert Micheletto for work at 110 Calhoun Street: to demo rear structure on main farmhouse and concrete pad at front, replace windows and doors to match existing, new driveway, street-side rock wall and gates. She seated members Boyer, Chute, Gilchrist, Smith and seated Alternate Hollinger for Mr. Kerr. Mr. Rod Pleasants of McIver Morgan Architects represented the owners.Demolish rear structure and concrete pad at front:
Mr. Pleasants looked over the plans with the members. He noted that the back section they are asking to demolish is in terrible shape and he recommended to the owners that they remove it since they can only have 1200sqft of usable space in an accessory building. Mr. Pleasants said they do not intend to put shutters back on; just paint the house white, as original. They would like to remove the big concrete pad at the front of the house and just put in one large stone step. He noted they are about six weeks from being finished with the main house and would like to get started on this guest house.Replace windows and doors:
Mr. Pleasants told the commission they would be replacing every window as original. Ms. Gilchrist noted that 1 over 1, as shown in the drawing, would not have been original. The members discussed the windows with Mr. Pleasants. More likely the windows were 4 over 4 or 6 over 6. Ms. Gilchrist said they were probably 6 over 6, and that would be fine but the commission will need to see a drawing to make sure they are proportional. Mr. Smith observed that the application is changing in regard to the windows. The members agreed that the application can be modified as long as there is no change in the dimensions of the windows. Mr. Pleasants said he would like to center the window on the 2nd floor over the front door. Mrs. Boyer asked about the small window at the peak. Mr. Pleasants replied they would probably leave that window as is, it just needs some repairs.New driveway, street-side rock wall & gates:
On the site plan, Mr. Pleasants pointed out the conservation easements to the commissioners. He said the existing stone walls on the property were overgrown. Their intent is to just clean them up and preserve the old look. The new dry stone wall they are proposing along Calhoun Street will match the old existing walls in style, material and height. Mr. Pleasants said the new wall will have one opening in front of the house for people and one larger opening for truck access. The wall will be kept as simple as possible. He added, the owners are anxious to get the wall finished in order to protect their child from the road. Mr. Smith asked if there is a picture of the wall. Mr. Pleasants said he could send a picture of the wall. Mr. Smith said it is not essential, but there should be a picture in the file. Mr. Smith asked if the wall will be 2 or 3 feet tall. Mr. Pleasants replied it will be approximately 30inches. Ms. Gilchrist stated she is very hesitant about a long run of stone wall. It would be a lot of wall, you would see it for a long time. You usually don’t see a stone wall across the front of a house. In addition, there is no reason to build a wall in front of a barn because space is needed to turn vehicles around. She asked if they could use another kind of fence. Mr. Pleasants commented on the long fence that starts at Sandra Canning’s house. Ms. Gilchrist agreed, that particular fence is long, but it does not cross the front of her house.The members discussed various options for a fence. Mr. Hollinger stated a child is not a good reason to build a wall. Ms. Gilchrist said she is worried about the solidity of a rock wall for such a long way - maybe a split rail fence with mesh would work. Mr. Chute commented, too much stone wall is suburban. Mr. Pleasants said he does not like the idea of a hedge – perhaps a combination of plantings and wall…. Ms. Gilchrist said the stone wall does not have to be solved tonight. Mr. Smith agreed. They could ask for further consideration. Mrs. Boyer stated that what HDC does not like is the solidity of a long wall. Mr. Hollinger suggested the members go look at the site. Mr. Pleasants said he would be happy to meet them there.
Mr. Pleasants asked if there were any objections to the driveway. Mr. Hollinger asked what type of material is to be used on the driveway. Mr. Pleasants replied it will be gray gravel and there is to be no curbing or lighting.
Mr. Pleasants showed the commission a picture of a lantern they want to use for lighting on the barn. Ms. Gilchrist commented that the light should shine downward and be of a simple, utilitarian design. This would help in keeping the barn looking like a barn.
Ms. Gilchrist commented that overall what they have done is keeping the character of the property in tact. It looks wonderful. Mr. Pleasants said the owners love it too.
Ms. Gilchrist asked if there were any additional questions or comments. There were none.

Ms. Gilchrist reconvened the Public Hearing at 7:34PM to consider the application for a Certificate of Appropriateness submitted by 175 Calhoun Street, LLC to replace fences, construct stone walls and an outdoor stone fireplace. She seated the members. Mr. and Mrs. Heyman were present with their attorney, Mr. Robert Fisher.Mr. Heyman introduced himself and his wife to the commission. He said their first house in the Calhoun Ives District was at 97 Calhoun Street where they did quite a bit of landscaping. He said they had no idea approval was required by HDC and apologized for not coming to the commission. Then, when they purchased 175 Calhoun Street, additional landscaping work was done including the stone work. Mrs. Heyman said they used a local landscaper and he did not tell them any permits or approvals were required. She added they have not had complaints from any of their neighbors. The members briefly discussed the new double gates which, according to photos received at the last meeting, are a copy of others in the district.
Ms. Gilchrist asked if there were any comments from residents. Mr. Futh, Kielwasser Road, spoke about the double gates. He said the Heymans replaced something that was there before there was an historic district commission. Mrs. Averill, Calhoun Street, said she is happy with what they have done. Mrs. Heyman told the members again that they did not mean to go against local law. They were just unaware they needed to apply for landscaping work. Atty. Fisher said he is aware that the commission does not consider plantings, but they will be adding plants in front of the stone wall facing the road. He also asked that the commission take into account that the stonework is more than 200ft from the road.
Ms. Gilchrist asked if there were any additional comments or questions. There were none.
MOTION:
To close the Public Hearing to consider the application for a Certificate of Appropriateness submitted by 175 Calhoun Street, LLC; to replace wooden pool fence with stone wall, construct stone wall near garage to screen automobiles and garage extension, construct outdoor stone fireplace and replace wooden fence.

Susan & Sam Averill /249 Calhoun Street /Ground mounted solar array behind barn
Ms. Gilchrist opened the Public Hearing at 7:57PM to consider the application for a Certificate of Appropriateness submitted by Susan and Sam Averill to install a ground mounted solar panel array behind their barn at 249 Calhoun Street. She read the legal notice which appeared in Voices on 10/9/11. Ms. Gilchrist seated the members. Mr. and Mrs. Averill were present.The members looked at the site plan and drawing of the barn showing location of the solar array. Mr. Averill stated the solar array will be installed behind the barn, angled toward the sun and will be located near the meter box at the barn. He explained that the idea is to keep the farm sustainable and the solar array is expected to provide 75% of the power they use at their house and barn.
The members discussed the placement of the solar panels. Mr. Kerr said the less visible the better. Mr. Averill said he needs sufficient room to be able to maneuver in and out of the barn with his tractor. Ms. Gilchrist asked Mr. Averill if he could give the commission a minimum/maximum distance between the barn and solar array. Mr. Averill said he will discuss this with the solar company but thinks the distance will be 25 to 75ft from the barn. Mr. Smith noted there is a slight slope behind the barn which would make the array less visible. Mr. Kerr asked if the size of the solar array is set. Yes. Mrs. Boyer asked about their time frame. Mrs. Averill said they have the grant and want to start before the end of the year, and will have one year to complete the project.
Ms. Gilchrist asked for comments from the residents. Mr. Futh, Kielwasser Road, said he had been a neighbor of the Averills for 42 years and expressed his support of whatever they want to do to preserve their farm. He also stated his disappointment that some structures in the district had been lost. Mrs. Heyman, Calhoun Street, noted that she and her husband also support this project.
Ms. Gilchrist asked if there were any additional comments or questions. There were none.

Ms. Gilchrist opened the Public Hearing at 8:15PM to consider the application for a Certificate of Appropriateness submitted by Lloyd Wexler, 157 Calhoun Street, to have a temporary construction access route in order to build a shade trellis and storage cabinet. He read the legal notice which appeared in Voices on 10/9/11. Ms. Gilchrist seated the members. Ms. Demetriades and Mr. Walker, architects, represented Mr. Wexler.The members looked over the photos and site plan showing the scale of the project and location of the walking trail, storage cabinet and trellis with Ms. Demetriades and Mr. Walker. Ms. Demetriades pointed out that the project is very small and very far from the road – approximately 730ft. She said this will be a place where Mr. Wexler can walk to and meditate. Mr. Kerr asked if the trail could ever become a public way. Mr. Walker replied no, the trail goes through wetlands.
Ms. Gilchrist asked if anyone had questions or comments. There were none.

The members discussed after-the-fact applications. Mr. Kerr said he accepts their explanation and suggests the application be approved. Mr. Chute agreed. Ms. Gilchrist said the commission needs to consider the question of allowing things to “happen”. Mr. Smith agreed and said he thinks by having this hearing, in a way, the commission has said “ok” – and needs to talk more about this. Ms. Gilchrist said she is concerned about future applications if the commission lets this one go. Mrs. Boyer suggested the commission tighten the Regs. After-the-fact applications should cost a lot more. Mr. Kerr agreed. He said he likes that idea. Mr. Smith said the commission needs to be much clearer about what they want in this district; simplicity and quality should be maintained.MOTION:

Mr. Kerr reconvened the Public Hearing at 7:30PM to consider the application for a Certificate of Appropriateness submitted by The Gunnery, 99 Green Hill Road, to replace the roof and other repairs to The Cottage. Mr. Smith and Mr. Hollinger recused themselves from this Public Hearing. Mr. Kerr seated Members Boyer, Chute, Gilchrist, Kerr and seated Alternate Mills for Mr. Smith. Mr. Kerr asked if there was anyone present for The Gunnery. Mr. Robert Ullram, Assistant Head–Business & Services, came forward to discuss the application.Mr. Kerr asked the members if they had any questions or comments. Ms. Gilchrist noted the commission had asked Mr. Ullram to come in to determine if the repairs were being done in-kind or if an application was needed. Mr. Ullram told the members that the material on the roof was different from the previous roof, but the new roof is the same as other buildings on campus. The siding and windows were replaced in-kind.
Mr. Ullram asked if a letter to the commission is all that is required when repairs in-kind are being done. Yes. He said he understands and going forward he will come to HDC.
Mr. Kerr asked if there were any additional questions or comments. There were none.

Mr. Kerr opened the Public Hearing at 7:41PM to consider the application for a Certificate of Appropriateness submitted by West Indies, LLC, to build a new house at 96 Calhoun Street. He read the legal notice which appeared in Voices on 9/11/11. Mr. Kerr seated the members. Mr. Harold Tittmann, Tittmann Design & Consulting represented the owner.Mr. Kerr read an e-mail from Sandra Canning, 119 Calhoun Street, supporting this application. The e-mail is in the applicant file and a copy is filed with these minutes. The members looked at the site plan. Mr. Tittmann explained there are 24acres, he pointed out the upward sloping fields which can be seen from Calhoun Street and said they are building on the highest field for privacy. The house will sit approximately 900ft from the public way. Mr. Tittmann showed the commissioners photos and drawings. He said the story poles are up but cannot be seen very well because of the trees, but they want the trees for privacy. Mr. Tittmann said it’s all about keeping the house as discreet as possible – parking is behind the house and the pool is down in back of the house.
Mrs. Boyer asked about the roof. Part of the roof will be hand split cedar shingles and part will be standing seam metal. Mr. Smith asked the reason for two different roof types. Mr. Tittmann replied the barn and garage will have the standing seam metal roofing with barn siding. The rest of the house will have the more traditional clapboards with the cedar shingle roof. Mr. Krimsky asked if it is unusual to sandwich a barn between clapboards like this. Mr. Tittmann replied yes it is, but there are a few examples in town, including Calhoun Street. He noted it is their intent to make the house seem like it has been there for a long time.
Mr. Kerr asked which way the lighted windows are directed. Mr. Tittmann said they will be at an angle from the road. Mr. Chute said he is very suspicious of that type window, but they are far from the road. Mr. Kerr asked Mr. Chute if his objection was to the lights or the architecture. Mr. Chute replied, architecture. Mr. Smith asked the other members if they have the basic essentials. Yes. Mr. Smith asked about driveway lighting. There is none. Mrs. Boyer asked about the basement. It is underground and there is no walk out.
Ms. Gilchrist pointed out that they are using several different window combinations. Mr. Tittmann stated all the windows are the same size – they just made an aesthetic decision – this is their preferred arrangement. The lower windows are French doors. Ms. Gilchrist said she prefers more uniformity. Her issue is with all the different kinds of windows. Ms. Gilchrist commented that the windows on the south side upper story would be visible. Mr. Tittmann said those windows were in the master bedroom and his clients wanted to see as much of the view as possible. He also pointed out that this bedroom is going to be the farthest point away on the house. Mr. Tittmann said he has made an effort to keep the house as compressed as possible.
Ms. Gilchrist said she would like to see the eaves be less boxy and would like to see more overhang. Mr. Tittmann said his client would not object. Ms. Gilchrist asked about the driveway and entrance at the road. Mr. Tittmann replied there is already an opening that people are using. The driveway will be a combination of gravel and asphalt. The driveway will not be seen from the road. Ms. Gilchrist asked if there are any plans for walls. The old stone walls will be left as they are.
The members went back to discussing the windows. Mr. Tittmann said the windows are a long way off. Mr. Krimsky asked if these windows would be visible in the winter. Ms. Gilchrist said the upper windows in the bedroom will be visible when lit up at night. Mr. Kerr said a couple of things aren’t perfect because we don’t know what the inside of the house is like.
Ms. Gilchrist commented that she would like for Mr. Tittmann to come back to the commission with a scheme of three windows on the south side master bedroom. He replied that he could do that tonight if the commission would give him a little time. All agreed to adjourn the public hearing until later this evening.

Mr. Kerr opened the Public Hearing at 8:57PM to consider the application for a Certificate of Appropriateness submitted by 175 Calhoun Street, LLC, to replace fences, construct stone walls and outdoor fireplace. He read the legal notice which appeared in Voices on 9/11/11. Mr. Kerr seated the members. Atty. Robert L. Fisher, Jr. of Cramer & Anderson, represented the applicant.Atty. Fisher came forward to discuss the application. He stated that Brett and Greg Heyman are the owners of 175 Calhoun Street, LLC. He read a letter from Mr. and Mrs. Heyman to the commission dated 9/19/11. The letter states that they were trying to return the property to some of its historic characteristics, to eliminate the view of the house and parking area from the road. Stones found on the property were used in the construction. Mr. and Mrs. Heyman stated they were unaware that commission approval was required. A copy of the letter is filed with these minutes and the original is in the applicant file.
The commissioners looked at a site plan and photos (rec’d 9/19/11) with Atty. Fisher. He noted that theirs is not a “contributing” house in the district. The photos of other fences and gates in the district showed that they tried to be consistent with what they built. Mr. Chute said he appreciates their letter and attempt to do the right thing, but he is pretty concerned about the fireplace, it’s pretty massive. When asked, Atty. Fisher said the fireplace is 9’9” tall, 56” deep and 6’ wide. He offered to bring photos of the fireplace, or the commission can go to the house. Mrs. Boyer said she thinks the applicants did know about HDC requirements because they lived in the district before and were sent a letter from HDC regarding the district.
Mr. Smith said the commission needs to deal with the applicants’ failure to apply in addition to considering whether the stone wall, fireplace and gate are appropriate structures. He added; we need to have a discussion. If this had been submitted in the proper way, would we have approved it? No, all agreed. Mrs. Boyer stated the fireplace, and stone wall are too high. Everything is out of proportion. Mr. Chute and Mrs. Mills agreed. Mr. Krimsky wondered about the motive behind the structure. Was the fireplace put up to sit outside and enjoy or was it to block the view of the modern house across the street. Mr. Kerr said the commission was very proud of that approval. Atty. Fisher said the height of the fireplace is to keep smoke away from people on the patio. After some additional discussion, the members decided they should go visit the site and continue this meeting until next month.
MOTION:
To continue until the next regularly scheduled meeting on October 17, 2011, the application for a Certificate of Appropriateness submitted by 175 Calhoun Street, LLC, to replace fences, construct stone walls and outdoor stone fireplace; in order for the Commission to have time for a site visit.

Wexler /157 Calhoun Street /Preliminary discussion re: small pool and trellis.
Ms. Demetriades and Mr. Walker, architects, were present for Mr. Wexler. They looked at a site plan (from their 2009 visit to HDC) with the commission. They explained that Mr. Wexler does not want a swimming pool. He just wants a small reflecting pool and a trellis for shade. The reflecting pool will sit even with the ground and since there will be less than 24inches of water in the pool a fence is not required. The shade trellis will be 8ft tall.There are a lot of wetlands on the property and Ms. Demetriades said the Inland Wetlands Commission has given permission for this project. The members determined that the reflecting pool will not be visible from the road but an application will be required for the shade trellis.

Ms. Gilchrist called the meeting to order at 7:47PM. She seated the members and seated Alternate Krimsky for Mr. Smith.There were several people waiting to have discussions with the Commission, so it was agreed to change the order on the Agenda so they would not have a long wait.

Sidewalk at First Congregational Church: First Selectman, Mark Lyon, introduced himself and Mr. David Werkhoven, Buildings & Grounds Trustee for the Church. Mr. Lyon told the members that he wanted Mr. Werkhoven to be at this meeting because he was most familiar with the sidewalk project. He said the two of them met with the Highway Department regarding the handicap access, the sidewalk along the road and the catch basin the Town is going to replace. The Town is going to assist the Church in helping with the sidewalk and improve road drainage in that area. The new sidewalk will match up with the sidewalk coming from the Library where there is a crosswalk. Mrs. Boyer asked if there was any way the sidewalk could be a darker color instead of dead-white. Mr. Lyon said he thought so, but would have to ask. Ms. Gilchrist asked if this choice of location is very critical. Because, she noted, on the rest of the Green the grass comes down to the street and creates a certain look. She asked if it would be possible to put the walkway more inland from the road to maintain the look of grass at the street. Mr. Lyon explained that would create a grade issue due to the sidewalk going up hill and may not comply with ADA rules. Mr. Chute agreed. The sidewalk will have a more gradual rise near the road. Mrs. Boyer commented on how dangerous the area is and asked if the sidewalk location could be moved. Mr. Lyon replied the new sidewalk will line up with the existing sidewalk at the Library and the crosswalk. They discussed the curbs. Mr. Lyon said installing curbs keeps people from parking on the grass. Ms. Gilchrist asked if there is any way of not needing an ADA ramp. Mr. Lyon replied whenever there is a sidewalk and curb, a ramp is required. The curbs are typically 4inches high. He also noted that all of the curbing on the Green is pretty old and is beginning to crumble and break apart. Mr. Kerr said he thinks there is a tint that can be added to concrete, also texture could be added. The members thought that would be good. Mrs. Boyer asked Mr. Lyon if he could get back to the Commission and let them know if tinting is possible. Mr. Lyon said he would discuss all this with Kevin Smith, the Highway Director, who does a lot of concrete work and will let the members know what he says. Mr. Lyon added, they would like to do the work this fall. Ms. Gilchrist asked if the commissioners had any more questions. There were none. Ms. Gilchrist thanked Mr. Lyon and Mr. Werkhoven for meeting with the Commission.
B. 175 Calhoun Street LLC /Discussion:
Atty. Rob Fisher represented the owners, Greg and Brett Heyman. He said his clients did not realize they needed permits. They removed flagstones from around the pool and that area is now grass. The wooden fence around the pool was removed because it had deteriorated and they replaced it with the stone walls, fireplace and gates. Mrs. Mills remarked that the fireplace looks funny from the road. Mr. Kerr wondered if the fireplace is subject to zoning or fire safety regulations. He also said Mr. and Mrs. Heyman will need to complete an application for a Certificate of Appropriateness. Ms. Gilchrist said she is not wild about the gate – it is not appropriate. Atty. Fisher said Mr. Heyman had copied the design of another gate. The members suggested he look at some other gates in the District. Mrs. Boyer asked if Mr. and Mrs. Heyman had ever received anything in the mail from HDC. Atty. Fisher replied they had not. Mrs. Boyer noted the letter sent to new owners is very explicit. Atty. Fisher said he will get an application to fill out.C. 5 Wykeham Road /Library Parking Lot Lighting:
Jean Chapin, Library Director, presented her lighting plan to the Commission. She explained to the members that the existing lights in the parking lot have been hit many times by cars as they pull in to park. Mrs. Chapin described the low, round brown lights, set into the mulch which will light the walk. Also, there will be three solid copper post lights with frosted chimneys. Rod Pleasants noted that these are reproduction gas lights. Ms. Gilchrist commented that the low fixtures sound great for the walk, but she is hesitant about the post lights. She would prefer the source of light be hidden, and provide down-lighting for the walkway. Mrs. Chapin noted that the parking area is not lit all the time; only when the Library is open. Ms. Gilchrist suggested when they come back with their application, they should choose a light in which the bulb is not visible; the simpler the better. Mrs. Boyer agreed. Lights should do their work, but not be so obvious.D. 2 Wykeham Road /Discussion:
The members discussed the fact that some neighbors have complained about the fact that a couple of shutters on the house are coming apart. It was noted that repairs do not fall under the jurisdiction of the Commission. The house is presently for sale.

Mr. Krimsky said the goal is good to keep the Green from being cluttered. Mrs. Boyer suggested a letter should be sent to the churches, and others on the Green reminding them to remove their signs once an activity is over.b.) The members briefly discussed whether they should change the fee for applicants who do “after the fact” permits.

Ms. Gilchrist invited Mrs. Chute to come forward and present their application. Mrs. Chute showed a site plan and some photos to the Commission. She explained to the members that the 48ft length of fence had been installed by their neighbor, Ms. Williamson, in 2004 and was removed by her this June. Mrs. Chute showed the members on the site plan where the fence had been installed on Ms. Williamson’s land about 2ft back from the property line which is located in the middle of the retaining wall. Mr. and Mrs. Chute are proposing to locate the new fence on their property in front of the retaining wall. Mrs. Chute explained to the members that their house is on the market and it is important for them to have a privacy screen between the two properties.
Mr. Kerr asked if their new fence would replicate what was there. Mrs. Chute replied the fence would look like the existing fence and would consist of 4ft high cedar picket fence sections consistent with existing pickets. Mr. Kerr said it appears that nothing except the fence would be visible from the public way. Mrs. Chute said that is correct. Mrs. Chute read the letter to the Commission specifying work to be done and materials used.
Ms. Gilchrist asked the members if there was any further discussion. There was none.

The members looked at the site plan and noted it was not entirely clear as to what materials would be used on the walkway. They agreed it would be a good idea to invite Mr. Lyon for a discussion at the August meeting. Ms. Gilchrist will write a letter.
b.) The Zoning Enforcement Officer wrote a letter to 175 Calhoun Street LLC regarding work done without permits. Ms. Gilchrist read this letter to the members and will wait to see if they reply.
Other Business
A. Photos of Historic Districts. Photos of the three districts were last recorded in 2006. The members agreed to take the photos again.B. Speaker. The members agreed there were issues they needed to ask advice about, but agreed to wait and discuss when all members were present.

Ms. Gilchrist opened the Public Hearing at 7:35PM to consider the application for a Certificate of Appropriateness submitted by Zemma Mastin White, 6 Parsonage Lane, to replace the front porch roof with standing seam metal roofing. Ms. Gilchrist seated the members. Mrs. White was present.Mrs. White told the members they had a lot of roof damage this winter which allowed water to come into the house causing even more damage. They were told by their contractor that a metal roof would last longer. The commissioners looked at the sample of standing seam metal roofing and also the photo of the house on which Mrs. White’s contractor had “photo-shopped” a metal roof on the porch. Mrs. White explained that they chose the charcoal color because it will match the color of the asphalt shingles on the rest of their house. Mr. Chute asked if there were gutters on the house. Yes. Mr. Smith asked if the gutter on the porch will remain. Yes. Mr. Smith wanted to know when they would be repairing the main roof. Mrs. White replied not right away.

Ms. Gilchrist opened the Public Hearing at 7:47PM to consider the application for a Certificate of Appropriateness submitted by Myanne and Jeffrey Doherty, 214 Calhoun Street, to revise their previously approved Certificate of Appropriateness. Ms. Gilchrist seated the members. Mr. and Mrs. Doherty were represented by their architect, Peter Talbot.Mr. Talbot read a letter to the Commission (dated 6/20/11) which stated that this letter and drawings requesting revisions are to supersede the letter and drawings submitted on 6/2/11. He also stated that the Zoning Commission did not want the guest house to have its own parking area because it would then appear to be separate from the main dwelling. Mrs. Boyer said she understands why the owners would want the additional parking, but also understands the Zoning point of view. Mr. Talbot said right now the owners have a parking area between the main house and guest house but he will need to come back to the Commission with an informal presentation of what they would like to do regarding parking.
Mr. Talbot went through the new drawings with the Commission. They are very similar to those submitted with the application on 6/2/11; just supplemented with more information. Modifications requested:
* Eliminate parking to east of guest house, relocate fence between guest house & pool barn to allow for parking (per Zoning).
* Extend screened porch 4’3½” beyond previously approved footprint to make porch more usable.
* Relocate pool equipment shed.
* Modify west wall and roof eave of guest house and east wall and roof eave of pool barn to accommodate sliding doors with insulated walls.
* Raise ridge height of proposed guest house 12” due to structural and code requirements.
* Increase length of pool from 42 to 50 feet.Mr. Kerr asked if this property is two separate lots. Mr. Talbot replied it was never separated, right now it is one big lot but the owners understand the property is sub dividable.

Mr. Kerr stated if the sidewalk is in the Town right of way, they don’t need to apply even though HDC has a right to advise. If the sidewalk is a Church project, they do need to apply. Mrs. Mills sent an e-mail to the members informing them that the new owners at 175 Calhoun Street are building a stone wall which is very visible from the road. Mrs. Boyer stated she had driven up to see the area and said she thinks there are two large stone walls. Mr. Chute said the fences are way back by the house. One stone wall hides the garage extension. The other is extended with a wooden fence. The Zoning Enforcement Officer will be asked to check this out.Mr. Krimsky asked if it was HDC policy to require photos when changes are made to a façade. Ms. Gilchrist replied that the commission does not always require photos but they strongly suggest that applicants submit photos of existing conditions. Mrs. Boyer suggested when a project is finished photos should be taken for the record. She added, the photos would also tell the commission whether the project was completed within one year. Mr. Kerr commented that the commission loses its jurisdiction after the C of A is granted. He suggested a photo of the finished project could be noted as a condition in the CofA. The members discussed the wording: for example, the condition of approval could be worded as ”…...Upon completion notify the commission that the work is finished and a commissioner will take photos from the public way for the record…...” It can be decided at the meeting whether commissioner or applicant will take the photos.
Mr. Smith said he thinks what the commission wants is a way to make sure that applicants are on board with what HDC requires. He commented that the members can make a lot of rules or they can make contact. He thinks in the long run, the commission should have more contact with applicants and stay in touch to see if the job is being done the way it was proposed. Mr. Hollinger agreed. While the work is in progress, HDC should be more engaged. Ms. Gilchrist asked if it should be a commissioner or someone from the district to stay in contact with the applicants. Mr. Smith thought the commission should talk about this again another time. He noted that this would be implementing a type of system HDC has never done before. Mr. Hollinger said it is almost like the site inspections done by the Inland-Wetlands Commission.
HDC needs to know when properties in the three districts change hands.
Mrs. Boyer wondered if the commission could work with the Assessor, Barbara Johnson, to let them know when someone purchases a house in one of the historic districts. She said she would be willing to talk with the Assessor on behalf of the commission. People need to know if they are buying a house in an historic district and they are not always told by their real estate agent. Mrs. Boyer also remarked that times have changed and people have changed and so have their attitudes. Mr. Smith wondered if attitudes would be different if, from the very beginning, HDC had more contact with new people so they would be more aware of what they are buying into.
Mr. Chute asked Mrs. Shade if she wrote a letter to The Gunnery about repairs being done to the Cottage on The Green. It was not done. This discussion should be added to the Agenda.

First Congregational Church /6 Kirby Road /Discussion re: items requested for clarification on 9-20-11
Mr. Kerr told the members he would have to be recused from this discussion due to conflict of interest. Ms. Gilchrist seated Mrs. Mills in his place.Mr. Reese Owens, Halper Owens Architects, read a letter he wrote to the Commission(dated 4-18-11) in which he stated that since last September, when the Commission issued a C of A to the Church for an Access Lift, two potential problems have arisen: 1)the open platform lift may “feel” insubstantial and uncomfortable, and 2)the mechanism of the proposed lift is prone to maintenance problems. As a result, the Church is proposing a modification which would make the addition smaller and simpler. Mr. Owens presented revised drawings dated 4/18/11. He also gave the Commission detailed photos which they had requested last September: Bluestone, iron railing to match existing, weathered CT wall stone, canopy light, door pull and call button.
Mr. Owens told the Commissioners that people who used a lift like the one previously proposed, found it unnerving. This new lift will be much more like an elevator. The new drawing shows the addition will extend out about 6 inches further that the previous one, but will be narrower and is overall smaller with no window and is 2½ ft lower than what HDC approved last September. Mr. Owens said he thinks smaller is better and asked the Commission if they were agreeable to the changes. Ms. Gilchrist said she thinks the addition will recede more than originally thought. Mrs. Boyer said the Church has the same simplicity as the library. Ms. Gilchrist noted the canopy light would probably not show and the source of light would not be seen from the public way. Mr. Owens said the same type of light is in other places on the Church.
Ms. Gilchrist asked the members if there were any additional questions or comments. There were none. Ms. Gilchrist said she appreciates the efforts which have gone into making this addition look like it belongs there.
MOTION:
To approve the plan submitted by the First Congregational Church, 6 Kirby Road, as modified and clarified in drawings D100 and D101 revised 4/18/11, and drawings D201, D202 and D203 dated 4/18/11; all by Reese Owens, Halper Owens Architects. Mr. Kerr opened the Public Hearing at 7:40PM to consider the application for a Certificate of Appropriateness submitted by Jeffrey and Myanne Doherty, 214 Calhoun Street, to convert the existing barn complex into guest quarters, pool, pool house, storage and workshop. He read the legal notice which appeared in Voices on 3/13/11. Mr. Kerr seated the members and seated Alternate Mills for Ms. Gilchrist and Alternate Hollinger for Mrs. Boyer. Mr. & Mrs. Doherty were present along with their architect, Mr. Talbot.
Mr. Doherty introduced his wife and himself to the commission and stated they had purchased this property last June and how much they love the area. He also said they felt very fortunate to be working with Mr. Talbot who has a considerable understanding of the historic districts.
Mr. Talbot looked at the aerial photo and site plan with the members and pointed out the eased portion of the property. He explained to them that he and the Doherty’s had gone through numerous options before deciding on this plan. One choice was to build in the open meadow, but they did not want to destroy the look of the historic fields. It was not easy coming up with a plan to maintain the historic nature of the property while trying to meet the needs of a growing family.
Mr. Talbot said tonight’s application is regarding the barn complex only. He will come back another time to the commission with an application for the Italianate house addition.
The members looked at the existing and proposed plans with Mr. Talbot. He explained that the only changes were in terms of proportion:
* He maintained the existing height and volume of the hay barn, and
* Steepened the pitch on the pool house roof.Mr. Talbot noted that the only other change they are considering would be to change the 2-light windows on the guesthouse barn to 6-light windows. Mr. Smith asked how many 2-light windows there were. Six.
Siding/Roof.
Antique vertical siding as well as antique horizontal siding will be used on the barn complex. Rather than asphalt, the roofs will be wood shake shingles.Exterior Lighting.
The only exterior lighting will be one sconce light beside the existing garage door, one by the pool house door and one by the guesthouse door. In addition, there will be one path light near the pool house and underwater lighting in the pool that will shine away from the street.Fencing.
There are to be two types of fencing. The cedar fence by the road cannot be seen through when looking at it straight-on; only when passing by. The 4-rail natural wood fence will have mesh on the outside(to protect the pool area) and will read as a paddock fence.Mr. Talbot recapped the changes for the commission:
Exterior siding is to be antique vertical siding and antique horizontal siding. Metalbestos flue for two fireplaces. Heavy cedar shake shingles on roof. Screened porch on north end of guesthouse; steel, painted gray and not very visible from the public way. He briefly discussed the eave and window detail on the drawing.Mr. Kerr said he was not at the commission meeting last month and asked Mr. Talbot what part of this project is not before the commission tonight. Mr. Talbot replied, the main house, and confirmed that would be for a future meeting.
Mr. Kerr asked if any member of the public would like to have a closer look at the plans being presented at this Public Hearing. No one came forward.
Mr. Talbot introduced Mr. Dirk Sabin, Landscape Architect and asked if anyone had any questions for Mr. Sabin relative to the pool or landscaping.
Mr. Chute observed that this presentation was pretty much what Mr. Talbot showed them at the last meeting with only a couple of variations. Mr. Kerr asked how the windows operate. Mr. Talbot said the windows would either be casement or crank out type. Whether 2-light or 6-light, they would operate the same.
Mr. Smith said he would like to see the pool plan again. Mr. Talbot said there will be a stone terrace at either end of the pool. There is an automatic cover to roll over the pool. Mr. Talbot said they referenced the footprint of the original bank barn and with the stone inlay around the pool it will appear to be sitting in the old barn foundation. Mr. Smith asked if the Building Department was ok with the fence being farther away and not directly around the pool. Mr. Talbot said yes, but they are very strict about checking all ways to enter and exit the pool area. Mr. Smith said he did not think the pool would be visible from the public way because of the way the ground slopes. Mrs. Mills said she thought the plans look good.
Mr. Kerr asked if there were any further questions or comments from the public or the commission. There were none.

Mr. Kerr opened the Public Hearing at 8:12PM to consider the application for a Certificate of Appropriateness for Ms. Cynthia Williamson, 10 Kirby Road, to replace the existing roof with Terne coated stainless steel. He read the legal notice which appeared in Voices on 3/13/11. Mr. Kerr seated the members and seated Alternate Mills for Ms. Gilchrist and Alternate Hollinger for Mrs. Boyer. Ms. Williamson was present.
Ms. Williamson looked over the Follansbee Steel brochure, sample and photos submitted by Ms. Williamson with the application. Ms. Williamson said this roof, TCS Satin, will look like old fashioned weathered copper. It seems to be a popular choice. She said the shed is not leaking and will not get a new roof at this time.
Mr. Kerr asked Mr. Chute if he had any comments or questions about the metal roof since he also lives in the Washington Green Historic District. Mr. Smith asked Ms. Williamson if she could explain to the commission why this roof is appropriate on the Green.
Ms. Williamson replied: 1) My understanding of old houses is they would do whatever would be the most sensible use of their money. It is not sensible to keep cutting down trees. 2) A metal roof would be less stressful on the house (no construction every 15 years putting on new roof). 3) Metal roof looks very old fashioned, like lead coated copper. (A list of historic buildings with metal roofs was included with the application). Mr. Smith asked Ms. Williamson if part of her argument is that a metal roof will look ok. Ms. Williamson said it would look better than ok and a metal roof would be a better use of our resources. Mr. Kerr read the list from the National Park Service of historic buildings with metal roofs.
Mr. Kerr stated the commission has not gone into the Regular Meeting yet, but assuming they approve this application, he said they would probably want to make a statement that there would be no precedental value; only because it would be such a new introduction to that district. If the commission, after the fact, does not like the metal roof, there will be no automatic future approvals. Mr. Smith commented that is theoretically true with each decision the commission makes, but you want to emphasize that.
Mr. Kerr asked if there were any questions or comments from the public. Ms. Eldridge, Washington Green resident, stated she thought the metal roof was a very good looking enhancement to the house and as a neighbor she approves. She said she hoped the commission would think of this metal roof as a “green” roof. Mr. Talbot said these metal roofs are seen a lot in New York State. He said the metal does gray over time and looks great on the roof. Mr. Kerr asked how high the standing seams were on these roofs. Mr. Talbot replied, 1 to 1¼ inches.
Mr. Kerr asked Ms. Williamson if the roof would require gutters. Ms. Williamson replied there are copper gutters now and she does not know if she will keep them. Mr. Kerr remarked that he likes the metal roof but would like to know about the gutters. Will the existing ones remain or will new ones be needed. Ms. Williamson said she will do without if possible, or get new ones if needed.
Mr. Kerr asked if there were additional questions or comments. There were none.

To approve the application for a Certificate of Appropriateness submitted by Lloyd Wexler, 157 Calhoun Street, to extend an existing Certificate of Appropriateness previously approved on 6/15/09, for alterations and additions to existing house, barn(garage), driveway and site as shown in photos and drawings by Demetriades & Walker. This work is to be completed by June 15, 2012; or else this approval shall be void.

To approve the application for a Certificate of Appropriateness submitted by Myanne and Jeffrey Doherty, 214 Calhoun Street, for Phase I of their project which will convert the existing barn complex into guest quarters, pool, pool house, storage and workshop space; per photos, site plans and drawings by Peter Talbot AIA Architects, received 3/18/11; with the stipulation that windows in the guest house barn can be 2-light or 6-light at owner’s option. This work is to be completed by March 21, 2012; or else this approval shall be void.

Mr. Kerr noted, for the record, that the proposed metal roof will be an enormous change in that area. If approved, this will be the first utilization of a metal roof on a house on the Green or any historic district. We don’t want to set a precedent. I hope we like it. The next application will be judged on how well we like this one and how it is received after installation.
Mr. Smith stated some arguments are persuasive, but he does not know where he stands on metal roofs in historic districts and intends to abstain. He added, it is essential that the metal weathers.
Mr. Chute said he would approve the application, but wants the commission to be advised regarding the gutters.
Mr. Kerr asked the members if they had more questions or comments. There were none.
MOTION:
To approve the application for a Certificate of Appropriateness submitted by Cynthia Williamson, 10 Kirby Road, to install a Terne coated standing seam stainless steel roof; TCS Satin finish(unpainted) by Follansbee Steel Company; and no gutter alteration without further application to this commission. This work is to be completed by March 21, 2012; or else this approval shall be void.

Other Business
A. Kleine & Micheletto /110 Calhoun Street.
Mr. Rod Pleasants, McIver-Morgan Architects, represented the applicants. Mr. Pleasants looked at drawing A2-01b(rec'd 1/27/11) with the Commission. Two types of windows were pictured. They were similar except one window could be opened and the other could not. Mr. Pleasants said the applicants prefer the window that opens over the stationary one. He said it will be the only window on that side of the house that can be opened.Mr. Chute said he thought the window looked good. Mrs. Boyer said she also prefers the look of the window that opens. All agreed. Ms. Gilchrist asked if the mullions are all true divided lights. Yes. Mr. Pleasants pointed out the large panels that could slide over the window and also the door. The tracks will be in the same position as they were originally on the barn.
Ms. Gilchrist asked the members if they had any other discussion or questions. There were none. Mr. Pleasants said he would apply at a later time for the driveway and outdoor lighting. He thanked the Commission for their time.
B. Doherty /214 Calhoun Street.
Mr. Talbot, Peter Talbot Architects, represented Mr. and Mrs. Doherty. He reminded the Commission that this was formerly the DiBenedetto property. Mr. DiBenedetto took down the old bank barn and a thorough documentation of the barn complex was done for the record. Mr. Talbot said he has been working with the new owners to determine what they would like to do with the property. He said they would like to have a main family dwelling with 4 to 5 bedrooms, a guesthouse with 2 bedrooms, a pool and a pool house.One consideration is to build a barn complex similar to the existing one in the meadow and build the house in the woods. Another option is to use the existing Italianate style main house as the residence and create a barn like attachment onto the back. Mr. Talbot proposed putting the pool in the existing barn so that the courtyard will remain open. He said the massing of buildings will remain almost exactly as they were. They intend to use antique siding on the barn, gray cedar shingles on the roof and would like to change the garage door to a barn like door. As you look into the courtyard there will be a large dark framed panel on the barn that can slide over the large area of glass. Mr. Talbot said he would also like to have a slide on the barn addition behind the main house.
The members discussed the fence. Mr. Smith said he did not like the fence. Mr. Chute agreed. He thought it was like a Kentucky horse farm fence. Mr. Smith noted a pool fence is for child control and should not be an open type fence. The members did not think it would be highly visible.
Ms. Gilchrist told Mr. Talbot she likes the concept of concentrating development with the original house as he has done. Mr. Talbot said he would be back in March and thanked the Commission for their time.
It was agreed that Mrs. Boyer would be moved up to regular member. Mr. Tilden said he would soon be resigning his position as alternate, but will stay until a new alternate is appointed. Some names were discussed and they will be called.
Election of officers was postponed until the March meeting.
The commission will continue with the digital inventory this spring and they agreed it should be updated each year. New photos will be taken of properties in the three historic districts.
