December 18, 2002

Susan Payne, Conservation Commission Chairman called the meeting to order at 7:00pm.

Linda Frank and Linda Potter were seated as alternates.

MOTION: Approval of the minutes of the December 4, 2002 meeting of the Washington Conservation Commission, Linda Frank made a motion to approve the minutes of the December 4th meeting with the following additions to paragraph three; They agreed that the easement would be beneficial to preserving the road side, buffering and protecting the rural/rugged landscape. Also adding the following comment to the end of paragraph three: Joe Gitterman recommended the word management be replaced with monitoring. Linda Potter seconded the motion and it passed unanimously.

The Chairman, Susan Payne informed members that terms expire in January 2003 for Joe Gitterman, Linda Potter and herself. Joe and Susan will be reappointed to a three year term and need to be sworn in by the Town Clerk before the January meeting. Linda Potter is stepping down from the Conservation Commission but will remain active on Greenway and Betsy Corrigan's sub-committee flora/fauna. Ms. Payne then introduced Kelly Boling who will be appointed to a three year term, to replace Ms. Potter and also needs to sworn in before the January meeting.

Referrals from other commissions: Susan Payne had a map with the landscape buffer plan for the Housing Trust's proposal at 16 Church Street. Dirk Sabin, Landscape Architect designed the plan. Mr. Sabin worked with existing plantings and used native species, creating buffers in areas where headlights would shine and create screening for utility and garbage sites. This planting will not be full and dense immediately. Joe Gitterman was concerned about the sight line on to Hinckley Road with the (3) parking spaces that allow people to back out onto Hinckley Road. There was discussion on the traffic issue. Susan Payne informed members that a traffic study will be done. Kelly Boling also asked if the dogwood tree located on the Hinckley Road driveway side (the one that is set back from the road) be an evergreen to create more screening. The Zoning Commission will do a site visit on January 5, 2003 and the Public Hearing is continued until January 13, 2003.

Report of 12/17 Planning Meeting with Chalder: Susan Payne reported that discussion was about the Business Districts in; the Depot, New Preston, Marbledale and Woodville. Members should look to the minutes from the meeting for further details.

Cell Tower Committee Report: There will be a public hearing on January 27, 2003 to amend the Zoning regulations with respect to cell towers. Phillip Markert displayed maps depicting potential cell tower coverage or "service area" with the (3) proposed cell tower locations; Route 109 in New Milford, the Congregational Church in New Preston and Rabbit Hill in Warren. He commented that most coverage was limited to the 202 corridor. There was some discussion on potential health concerns and Phil stated that there is a sufficient lack of conclusive evidence for health issues. Mr. Markert also had pictures of various types of cell towers disguised as trees, flag poles, as well as the regular "looking" cell tower. During work with his subcommittee Phil has learned that companies can add panels to existing cell towers, cut the height of the towers and have less antennas by combining technology. The next step for the cell tower subcommittee is to provide information to Hank Martin. Pam Osborne, secretary is working on a write up by Phil Markert this will wind up his subcommittees work.

Town of Washington - Accepting land: no report

Subcommittee Reports:

a. Scenic Vistas/Roads - Joe's subcommittee has cut the first draft down in size and simplified the language. The document is being circulated again for further input from subcommittee members.

b. Greenway - next meeting date January 7, 2003 at 4:30pm.

c. Flora/Fauna - no report

d. Water Resources - Kirby Brook evaluation - no report

e. New-appoint committee to create Land Use Info/Welcome Pamphlet - identify members - Pam Osborne, secretary circulated a memo to Land Use Commissions and others.

Other Business:

Susan Payne forwarded a memo to George Bender, Chairman of the Planning Commission addressing the Conservation Commission and Greenways interest in the "Old Town Garage Site" future plans.

Joe Gitterman asked if anyone other than the Town of Washington had been approached about the easement for the 121 West Church Hill Road property. Joe felt that is was the wrong way to set precedent for acquiring future easements, no one asked for the Conservation Commissions input. Susan Payne stated that by state statute and as a result of the Planning Commission regulations the Conservation Commission is committed to accepting these easements. There was discussion on the burden of monitoring these easements, contracting with an outside party to do the monitoring and the need to budget for the monitoring expense. Joe stated that policy needs to be established for accepting these easements. It was decided to continue this discussion at the next meeting.

Pam Osborne was asked to generate maps from the digitized mapping system. Chris Charles requested (3) maps. Members discussed fees for these maps - it was decided to charge $5.00 per map.

Linda Frank informed members that the Lake Waramaug Task Force has created a strategic plan which includes weekly checks for invasive species, attending local Zoning meetings of the (3) towns, etc. The Task Force is also concerned with watershed preservation and will continue the trout stocking.

Approval of the minutes of the November 20, 2002 meeting of the Washington Conservation Commission, Linda Frank made a motion to approve the minutes of the November 20th meeting with the following addition to page 2, paragraph 3 under Subcommittee Reports, Flora has been changed to Flora & Fauna, Phil Markert seconded the motion and it passed unanimously.

Referrals from other Commissions: There being no official referrals from other commissions members concluded discussion on two properties (Cass/DePecol at 46 June Road & Rizzo/James at 129 Bee Brook Road) from the November 20th meeting.

Susan Payne read a memo she submitted to The Inland Wetland Commission regarding the Cass/DePecol. Members were confident that Candace Korzenko would relay our input to The Inland Wetland Commission about the Rizzo/James property at 129 Bee Brook Road.

West Church Hill Road Conservation Easement: Susan Payne, Betsy Corrigan and Elaine Luckey did a site visit to the Nassar/Uruburu/Schneider property at 121 West Church Hill Road. They agreed that the easement would be beneficial to preserving the road side. First Selectman, Elaine Luckey clarified that she has accepted the conservation easement but has not yet turned it over to the Conservation Commission for management.

Cell Tower Committee Report: Phil Markert began by informing the commission that there are three applications pending that affect the Town of Washington (Route 109 in New Milford, New Preston Congregational Church & Rabbit Hill Road in Warren). Phil felt that taking the simple approach of asking the cell tower companies to modify the towers was the way to go. Modification meaning cutting the height of the towers, asking that they look like trees, asking all carriers to use the same antenna and allowing town and emergency agencies use of the tower. Bob Fairbairn has produced five maps showing various locations and frequencies of cell towers. At this point Mr. Markert feels the subcommittee has done what it set out to do, which was educate themselves on cell towers. His desire is to recap what has been learned, include Mr. Fairbairn's maps and present this to the Conservation Commission, which will then forward the information to Hank Martin and the Zoning Commission. The Zoning Commission represents the Town of Washington on cell tower issues and at this point Phil feels that giving the Zoning Commission the information and the offer to assist them in any way is the best way to wrap things up. This will also wrap up the joint effort between the Conservation Commission and the Washington Environmental Council.

Susan Payne offered members a copy of a letter written by Debra R. Avery dated November 19, 2002 regarding the AT&T cell tower application for the New Preston Congregational Church (the letter will be filed with the December 4th minutes). Discussion ensued on the Zoning Regulations regarding cell tower placement, the town's jurisdiction over the New Preston application and potential health issues.

Canoe Brook Status: Linda Frank continues to work with Randy Bernard and Elaine Luckey on figures for this project and getting prepared for work in the spring.

Town of Washington - Accepting Land: no report

Subcommittee Reports:

Scenic Vistas/Road: Joe Gitterman is continuing to work on the first draft of a Scenic Road Ordinance.

Greenway: Greenway met on Tuesday December 3rd. Susan Payne will draft a letter to the Planning Commission about their interest in the Old town Garage site. The work at the Washington Primary School site all came together. Work continues on the East Aspetuck River Greenway and Kelly Boiling has been appointed chair of the Highway Discontinuation Committee.

Flora & Fauna: no report

Water Resources: Randy Bernard will be doing testing at various locations along the Kirby Brook.

Other Business:

Susan Payne informed members that the minutes from the Planning Commissions Special Meeting of November 19th relate to the Conservation Commission, specifically open space set aside and fee in lieu.

November 20, 2002

Susan Payne, Chairman called the meeting to order at 7:00pm.

Ms. Payne introduced Candace Korzenko, a member of the Inland/Wetland Commission. Ms. Korzenko will be a liaison between the Conservation and Inland/Wetland Commissions.

Linda Frank was seated as an alternate.

Approval of the minutes of the November 6, 2002 meeting of the Washington Conservation Commission, Ruth Alex made a motion to approve the minutes of the November 6th meeting Susan Payne seconded the motion and it passed unanimously.

Referrals from other Commissions: There were no official referrals. Conservation members discussed two applications that are before the Inland/Wetland Commission. The first one pertained to the Rizzo/James property at 129 Bee Brook Road. Ms. Korzenko explained that the property owners want to terrace the bank along the Shepaug River in order to control erosion. The owners are looking to install gabions planted with willow sprouts for camouflage. Ms. Korzenko went on to state that the erosion problem is not from the river but is a drainage problem originating from the house and driveway. The area in question is a nice natural area with hemlocks and Candace feels that the cutting up of the hemlocks exposed the site of erosion. Betsy Corrigan suggested the terraced area along the river be planted with low native species plants and she was also concerned with the probability of added top soil to the area and its future effects on the root system of the hemlocks. Susan Payne suggested that Conservation members drive by to look at the area and discussion will continue at the December 4th meeting.

The second site discussed was Cass/De Pecol property at 46 June Road. Dorothy Hill, Chairman for the Inland/Wetland Commission has asked for written input from the Conservation Commission. Members were in agreement that the two main concerns were minimum cutting and not destroying the under story. Susan will draft a letter to that effect.

Report of Meeting Re: TPOCD with Glen Chalder (11/20): Susan Payne reported that discussion continued on the Development Section of the Town Plan of Conservation and Development. Ms. Payne once again reminded members of the availability of the workbook which coincides with the work being done on the Plan of Conservation and Development, the workbook is located in the Land Use office. Also Susan reminded members to submit any suggestions in writing to Janet Hill, Planning Commission secretary. The next Special meeting of the Planning Commission for work on the Town Plan of Conservation and Development is December 17th at 4:00pm.

Cell Tower Committee Report (Meeting 11/20): Phil Markert and his subcommittee met with Bob Fairbairn of Radio Communications Association this morning to discuss placement of cell towers in Washington. At present there are two applications which affect the Town of Washington. One proposed site is on the Kimberly Farm off of Route 109 in New Milford and secondly a proposal for the steeple in the New Preston Congregational Church. There is also a proposed future site located off of Rabbit Hill in Warren. Working with Mr. Fairbairn Mr. Markert hopes to compile information that will be used to suggest locations for cell tower placement in Washington. Phil feels that cell service is a federal and state priority and he wants to be proactive. The Washington Environmental Council is paying for Bob Fairbairn's services and the Conservation Commission is grateful to them for their contribution.

Town of Washington - Accepting land: Ruth Alex is researching the proper and legal way for the Conservation Commission to accept easements from the Planning Commission. Ruth has been in contact with Atty. Mike Ziska, Tom O'Dell of CAIWCC, and Tom McGowan. Easements may be acquired by a majority vote at a Town meeting or the Selectman may accept easements. Atty. David Miles will research this for Ruth also. The process would be to long if all acquisitions were to go to a Town meeting. Ms. Alex presented a map and copy of an easement for the Nassar/Uruburu/Schneider property at 121 West Church Hill Road. The Planning Commission required open space set asides for this sub division. Members felt the easements will protect the natural character of the land. First Selectman Elaine Luckey has accepted these easements and at the Selectmen's meeting on November 21st will charge the Conservation Commission to oversee their management.

Subcommittee Reports:

Scenic Vistas/Roads: no report

Greenway: Saturday November 23rd Elaine Luckey will be leading a walk to Mt. Tom.

Flora: Betsy Corrigan has met with her subcommittee which includes Natalie Dyer, Susan Branson, Robbie Barnett, Linda Potter and Dirk Sabin. Betsy, Susan and Natalie are working on invasive species in Steep Rock. Betsy would like to use this work and possible work on town owned sites as an educational tool for the public. Ms. Corrigan also spoke of road side control and timed cutting of roadsides. She identified Lake Waramaug and Meeker Swamp as important "bird areas". Information on a Biodiversity Project was circulated. Betsy would like to pursue this project with area towns and have it mesh with the Town Plan of Conservation and Development. Dirk Sabin continues to work on the town arboretum. Betsy has spoken with Rex Swain about posting invasive species information on the Town web site. She would also like to set up an educational outreach area with pamphlets etc., located in a place with a high volume of community traffic. Ms. Corrigan feels that more work needs to be done in advising other commissions and alerting them to site specific problems. Bridging the gap between science and land use. Betsy had a copy of "Best Development Practices - Conserving Pool-Breeding Amphibians in Residential and Commercial Developments in the Northeastern United States. Secretary, Pam Osborne will order a copy for the Conservation Commission and Candace Korzenko will tell the Inland/Wetland Commission about the publication. Lastly Betsy reports that state archeologist Nick Bellantoni is working on a town parcel map to identify archeological information.

Water Resources: no report

New-appoint committee to create Land Use Info/Welcome Pamphlet - identify committee members: It was agreed that new people are needed and representation from commissions is needed. Candace Korzenko agreed to be on the committee and Liz Dexheimer also agreed to join.

There being no new business the meeting was adjourned at 9:00pm.

Approval of the minutes of the October 16, 2002 meeting of the Washington Conservation Commission, Linda Frank made a motion to approve the minutes of the October 16th meeting with the following changes; page one first sentence should read Chairman, Susan ....., page one under Discussion of Zoning ..... Commissions referral of proactive siting ....., Linda Potter seconded the motion and it passed unanimously.

Referrals from other commissions: There were no official referrals.

Susan Payne went on a site visit to the Cass/DePecol property at 46 June Road in New Preston. This is a 23 acre site with a proposed 2100' driveway. Susan is concerned with the potential cutting of trees and shrubbery on the property. Members reviewed plans from the Inland/Wetland file and were encouraged to do a site visit.

Report of Meeting of Land Use Commissions Chairs (October 22nd): Pam Osborne demonstrated the Arc View program at this meeting. Ms. Payne expressed the need to set up policy for use of the Arc View program. Susan felt that the meeting went well and that the Chairmen felt it was important to meet occasionally to keep open communication between committees. They will schedule a meeting for January. At that January meeting Susan asked Elaine Luckey to include discussion on the permit process, for the Town of Washington, on the agenda.

Cell Tower Committee Report: Phil Markert was out of town, so there was no report. Susan Payne told members of the upcoming meeting of the Cell Tower Subcommittee. They will be meeting on November 20th at 10:00am, on the third floor of the Town Hall. The subcommittee will be meeting with Bob Fairbairn of Radio Communications Association about placement of cell towers in Washington. Interested members are encouraged to attend. Susan also informed members of an upcoming Public Hearing on the proposed cell tower off of Route 109 in New Milford, which is scheduled for December 11th at 3:00pm and 7:00pm, at the New Milford Town Hall.

Subcommittee Reports:

Scenic Vistas/Roads: Joe Gitterman will be having a strategic planning meeting to review, edit, and rewrite the first draft of the proposed Scenic Road Ordinance on November 21st at 3:00pm at his home. Interested members are welcomed to attend.

Greenway: Greenway met at the Old Town Garage site on Tuesday November 5th and then continued their meeting at the Steep Rock office in the Depot. Susan reports that the planting is done at the Washington Primary School site. Two new members have joined Greenway; they are Julie Adams and Kelly Boling. Both Ms. Adams and Mr. Boling are New Preston residents. Members discussed links to the Greenway located along the East Aspetuck River from the New Milford town line to Lake Waramaug, links with Roxbury, and utilizing unimproved roads as trails. Secretary, Pam Osborne will send minutes to Linda Banks.

Flora: Betsy Corrigan had an article on Invasive Plants published in the Steep Rock Vista.

Water Resources: no report

New-appoint committee to create Land Use Info/Welcome Pamphlet: Pam Osborne, secretary has spoken with several area towns, none of which have a pamphlet or informational guide for Land Use. Linda Frank will research more. Susan Payne said information gathered will be reviewed after the first of the year.

Other Business:

Pam Osborne, secretary submitted meeting dates for 2003 which will be circulated to all Conservation Members.

MOTION: Approval of the minutes of the September 4, 2002 meeting of the Washington Conservation Commission, Joe Gitterman made a motion to approve the minutes of the September 4th meeting with the following correction, under "Subcommittee Reports - Water Resources" the date should be October 2nd, not October 4th as stated. Ruth Alex seconded the motion and it passed unanimously.

Subcommittee Reports:

Scenic Vistas/Roads: Pam Osborne continues to work on the first draft of the scenic road ordinance. Pam will get the document back to Joe Gitterman to proof by his subcommittee.

Greenway: Susan Payne mentioned that Greenway is still looking for a representative from the New Preston area. Susan also asked Pam to notify members that the October 1st 4:30pm meeting will be held at the Washington Primary School grounds. Members are going ahead with planting in the school yard section of the Greenway. Dirk Sabin and Susan Payne have had discussion about the East Aspetuck River area.

New-appoint committee to create Land Use Info/Welcome Pamphlet: Pam will check with area towns to see what they offer.

Canoe Brook Project Update: Linda Frank has no new information to share.

Land Trust Issue: Susan Payne circulated a memo she had received from George Bender and stated that George Bender, Michael Jackson and she had met on Tuesday September 10th to discuss open space management. Susan asked members if they felt that the Conservation Commission wanted to become recipients of land. Linda Potter raised the question of the burden of monitoring and the legal obligations that go along with the monitoring. Joe Gitterman added his concern for the potential disaster of monitoring the "mini" land parcels created in development set asides. Members felt that the town could work together with existing land trust organizations (Steep Rock, Weantinoge etc.) without creating a new entity.

MOTION: Joe Gitterman made the following motion, the Conservation Commission strongly urges that no new entity be created to accept open space for the Town of Washington and that Steep Rock Association or an existing land trust organization or professional be utilized; as a last resort the Conservation Commission would accept parcels for the Town of Washington and would contract with a qualified organization/professional to do the necessary monitoring of the parcel, seconded by Ruth Alex and passed unanimously.

Members went on to discuss the Conservation Commissions' input on the "set asides" created for open space. The issue of using wetlands as these set asides was raised once again and members felt this needed to be resolved. Susan will speak with Janet Hill, Planning Commission secretary and George Bender Chairman of the Planning Commission.

Other Business:

Pam Osborne, secretary asked members about submitting minutes to the town website. Members decided that the minutes would be submitted after they had been approved.

Joe Gitterman inquired about the Commission Chairs meetings. Susan stated that the Chairs had met once; she will contact First Selectman Elaine Luckey about scheduling.

MOTION: Approval of the minutes of the July 17, 2002 meeting of the Washington Conservation Commission, Ruth Alex made a motion to approve the minutes from the July 17 meeting with the following spelling change; page two, paragraph two under "other business" Nick Belintoni should be Nick Bellatoni, seconded by Joe Gitterman, passed unanimously.

Referrals from other commissions: none

Cell Tower Committee Report: Phillip Markert, Chairman for the Cell Tower Committee updated the commission on its membership which includes: Liz Dexheimer, Valerie Friedman, Paul Graney, Candace Korzenko, Susan Payne, Dimitri Rimsky, Peter Talbot, Dirk Sabin and Elaine Luckey. Their objective is to be proactive with the cell tower issue and to funnel their input to the Connecticut Siting Council on Cell Towers, Phil is confident that this council will accommodate reasonable town needs. Phil stated that it is evident people want cell tower coverage and the Cell Tower Committee is educating themselves on the process and operation of cell towers. The committee hopes to have a meeting in early October with a representative from Sprint to gather more information. It is Phil's feeling that companies have little interest in servicing the Town of Washington but are very interested in servicing the Route 202 corridor.

Subcommittee Reports

Scenic Vistas/Roads: Joe Gitterman reported that he has submitted the first draft of the "Scenic Road Ordinance" to Pam Osborne, secretary today. Pam will type up a first draft and e-mail it to Joe.

Flora: no report

Water Resources: Susan Payne will invite Randy Bernard to the October 4th Conservation meeting.

New-appoint Committee to create Land Use Info/Welcome Pamphlet: It was decided that this committee will wait until some of the ongoing issues are wrapped up.

August 21 Planning Comm. /Planimetrics meeting re: Section 4/4a Conservation of TPOCD: Members received an outline of the August 21st meeting from Glen Chalder. Phil Markert submitted written comments about the August 21st meeting to Pam; she will forward them to Janet Hill. Conservation members who attended the August 21st meeting thought the meeting was constructive, people present had an opportunity to voice their opinions, and they felt that Glen Chalder was listening to input. Joe feels that the POCD (Plan of Conservation and Development) is going to be a well thought out document and is in hopes that it will not become a "coffee table book" but more of an action plan. Phil felt that the impetus for what goes on in town comes from older people, which means there is a bias. He feels that land preservation is rolling along quite nicely and to have an effective plan there needs to be a strong community component. Phil's thought is most people like the town as it is, but to keep it that way a lot needs to be changed and Phil doesn't see that in any of the planning notes. Younger people need to be involved in the planning process. Members discussed housing and employment issues, young people can't afford to come and older people can't afford to stay. To keep the diversity in the community changes need to be made.

Canoe Brook Project Update: no update

Greenway: Susan Payne submitted minutes from the September 3rd meeting of the Greenway Committee. Work continues on the schoolyard beautification plan, the committee will be doing planting on the river side split rail fence installed by the Greenway. Greenway is waiting for the school to install split-rail fence where chain linked fence was removed. They are making headway with the eradication of knotweed and trail maintenance is going well. The committee is also working on Greenway links and is looking for a representative from the New Preston area. They will meet again on Tuesday October 1st at 4:30pm.

Susan Payne distributed copies of the draft of revisions to the Washington Zoning Regulations Section 14. Members should review them and contact Janet Hill at 868-0844 with comments by the September 23rd zoning meeting. Pam will mail out copies to absent members.

The Chairman, Susan Payne distributed a draft of the 2002 Annual Report, she asked members to review it and report back to her on comments and corrections ASAP. Pam will mail out copies to absent members.

Approval of the minutes from the June 19, 2002 meeting of the Washington Conservation Commission; Joe Gitterman made a motion to approve the minutes from the June 19th meeting, seconded by Ruth Alex, passed unanimously.

Subcommittee Reports:

Scenic Vistas/Roads:

Joe Gitterman reported that things are progressing and expects to have a written document by September. Once again he thanked Elaine Luckey for all her input and information.

Flora:

Betsy Corrigan reported that she hasn't met with her subcommittee again but will soon. Betsy did share some pest alerts with members, giant hogweed and water chestnut; which have both been found locally. A concern with giant hogweed is the toxic sap which can cause scaring. The water chestnut has been found in Bantam Lake. Betsy will post notices in the Town Hall. Betsy felt that efforts should be focused on educating the public on the "new" evasive species that are more easily eradicated. Addie Roberts suggested posting notices on the Town's web site. Betsy will contact Rex Swain. Dirk also suggested using the "Wanted" posters that were used several years ago to draw peoples attention. Betsy hopes to meet with small groups of people to do walks and site visits, through Steep Rock. In closing Betsy mentioned she had spotted native lupines on the road side, she asked Elaine how best to save the area from road side mowing. Elaine asked Betsy to get her "site specific" information and she will relay it to the highway crew.

Water Resources:

Susan received a memo from Phil Markert. Pam Osborne, Secretary will copy this letter and send it to all members.

Greenway:

Susan Payne stated that the Greenway map is now on the town's web site. She also reported that the Washington Garden Club made a donation of $500 to Greenway. The Greenway committee continues work on links to the existing Greenway through the Roxbury Land Trust, Mt. Tom and Bonnie Mathews is researching unimproved roads. Ruth Alex asked about the footbridge connecting Riverwoods to the walking path at Washington Primary School. Addie Roberts is spearheading this project and reports that the footbridge is still in the planning stages. Ms. Roberts states that Atty. Fairbairn is doing some investigating (pro bono)work on the access to properties. Susan Payne also added that Greenway will be making a proposal for the Old Town Garage site. Greenway will not meet in August and is scheduled to meet next on September 4th.

Planning Commission 7/16 meeting on Conservation Section:

Susan began by stating that the time for the Special Planning meeting was changed. Susan voiced her frustration with the work that has been done, she stated that the Open Space Interim Report would answer a lot of the questions being raised. A lot of work has already been done on the Open Space Plan. The open space inventory subcommittee has gone as far as it sees fit until they receive public input. Jack Field and Susan Payne have been working through George Bender, Chairman of the Planning Commission, in regards to the Plan of Conservation and Development. Susan as well as members feels the Conservation Commission should be involved, there are lots of people available and willing to help. Dirk responded by stating that Glenn Chalder was told to follow the Natural Resource Report and is sure he didn't realize there was such a vocal/spirited group willing to help. Dirk asked Susan for a copy of the Open Space Map, parcel map and analysis of parcels work that the Open Space Inventory subcommittee did. Elaine Luckey gave Dirk her up-to-date copy of the parcel analysis and Susan gave Dirk the Open Space map and will get him the parcel map for coping. Chris Charles spoke up and asked that Conservation members communicate their comments through Planning (via Janet Hill) and not to Glenn Chalder. He feels that part of the Planning Commissions frustration is constraints on time and budget. The Planning Commission is trying to do the best update of the Plan of Conservation and Development within the time and budget. Chris added that the Planning and Conservation Commissions need to get together to talk. Addie Roberts added that the booklets and memos, from Planimetrics, are not a finished product, but a work in progress. Addie also feels the two commissions (Planning and Conservation) need to be kinder to each other. Susan stated that voicing opinions should not be misinterpreted as hostility and the frustration is with Glenn Chalder and not the Planning Commission. She feels Glenn is not hearing comments being submitted. The Planning Commission is doing the best job possible with this big responsibility. Dirk recommended written comments through Janet Hill, which is what Susan has been doing. Ruth added that there is a lot of work that has already been done. Margie Purnell interjected that these documents are in predraft form and Glenn is most likely "testing the waters" and to wait for the draft of the Plan of Conservation and Development. Margie went on to say that she felt this is an education for both the Town and Glenn Chalder. Susan distributed copies of Chapter 4 to all Conservation members and asked them to review it. By Jack Field's count there are 128 strategies listed in Chapter 4 and Susan would like members to narrow this down and perhaps add ideas that are not already in this chapter. The next Special Planning meeting is scheduled for August 21st at 4:00pm. Both Addie and Chris stated that the Planning Commission is more than willing to change the time to 7:00pm if that is better for Conservation members.

Canoe Brook Project Update:

Linda Frank reports that Randy Bernard (of the Washington Environmental Council) and Dirk Sabin are working together on this project. Linda referred to the town budget for 2004/2005 a line item for proposed work on Canoe Brook and also a budget item for 2003/2004 repaving the rear parking lot at the Town Hall. Dirk states that this planning is in the early stages. Linda circulated pictures of "Carter's Wall" on Walker Brook Road and a bridge also on Walker Brook Road built by the Town of New Milford. Betsy went on to voice her concern for passages to/through wetlands in animal habitat areas.

Samson Driveway:

Joe Gitterman reports that things are growing but has not checked out the removal of debris. He will do so in the near future.

Housing Report:

Pam distributed copies of the Final Report of the Housing Study Committee.

Other Business:

Members discussed the Zoning meeting with the Cell Tower representatives. Discussion centered around being proactive and identifying sites ahead of time. The Route 202 corridor is a very likely site and there has been talk of the steeple at the New Preston Congregational Church. The State Siting Council has the authority over local Zoning Boards by towns can give input. Joe Gitterman asked about installing cell towers in power company right-of-ways and Linda Frank asked about removal of towers should they become obsolete. Elaine and Pam will look for information from Sprint on potential cell tower sites.

Betsy updated members on her ongoing work with Nick Belintoni and Ned Swigart on archeological mapping. They will be adding approximately 40 more sites in Washington and are also working on model regulations. Betsy stated that at this point she needs a digitized parcel map. Joe Gitterman stated that speaking from his own experience there is a lack of knowledge on the part of new comers to town about the historic, cultural or archeological aspect of ones property. Joe feels that person to person contact is needed. Somebody has to take a constructive interest and have a proactive attitude to help inform people. Members agreed that the best place to start is through the Real Estate offices; but this doesn't seem feasible. Pam will obtain copies of the tax assessor's conveyance tax forms for the next meeting.

The commission has received the report it requested form the CT Council on Environmental Quality, Susan Payne took this information home to look at.

The Natural Resource Report disc is back in the file (returned from Planimetrics).

Pam will forward the CACIWC membership for the Conservation Commission to the First Selectmen's office.

Approval of the minutes from the May 22, 2002 meeting of the Washington Conservation Commission; Ruth Alex made a motion to approve the minutes with the following change in paragraph one, line five exchange the word precedent for the word president, seconded by Joe Gitterman, passed unanimously.

Subcommittee Reports:

Scenic Vistas/Roads: Joe Gitterman reported on his subcommittee. Joe started by thanking Elaine Luckey for all the input and resources she has contributed to this subcommittee. Joe feels she has done an incredible job relaying a lot of useful information to them. This subcommittee's last meeting will be next week, June 25th from 6:00 - 7:30pm. They will be having a guest speaker, a selectman from Simsbury who assisted that town in enacting a "Scenic Road Ordinance". At this time the subcommittee is word-smithing a draft of a "Scenic Road Ordinance". Joe expects to have a first draft done by the end of July and Pam Osborne, as secretary will be putting the draft into disc form to be emailed to interested parties. Joe and his committee are concerned with the Planning Commission's reaction to the "Scenic Road Ordinance". By State Statute the town may only delegate the power to designate scenic roads to the planning commission or a combined planning and zoning commission. Susan Payne will talk with George Bender. Joe stated that with many area towns having a "Scenic Road Ordinance" already in place, it would be in keeping with the towns plan to protect rural character to have a "Scenic Road Ordinance". Chairman, Susan Payne once again commended Joe and his subcommittee for all their work.

Water Resources: no report

Greenway: Conservation members received copies of minutes from the June 4th meeting of Greenway. Greenway is working on putting their map on the Town of Washington web site.

Follow up with Planning Commission: Susan Payne referenced a three page memo she submitted to George Bender, Chairman of the Planning Commission and Glenn Chalder, of Planimetrics, commenting on Section #4 of the workbook for the Plan of Conservation and Development. Pam will copy this memo and distribute it to conservation members. It was decided to continue using the terminology that is used in the Natural Resource Report. Also it was agreed upon to acknowledge the Natural Resource Report, Open Space Steering Committee Report and Housing in the Plan of Conservation and Development. At the meeting they also discussed forming a new "Washington Land Trust", which both Elaine Luckey and Susan Payne felt should be under town jurisdiction and were opposed to forming another private land trust. The review of Section #4 of the workbook was continued to the July 16th special meeting of the Planning Commission.

Canoe Brook project Update: none

Samson Driveway Project Update: Joe Gitterman reports that the driveway has been moved and the area reseeded. Ruth Alex asked about the removal of debris from the land. Joe will check on this and report back to the commission.

Driveway Ordinance: All members received a copy of the most recent driveway ordinance. Members felt that this ordinance/application seemed sufficient.

Housing: no report

Other Business:

Susan shared an article on the controversial removal of Norway Spruce trees in New Preston. The owners eventually removed two of the five trees.

Members discussed how area towns write and receive grants.

Susan Payne attended a committee chairman's meeting on Thursday June 13th at Selectman Nick Solley's home.

Pam will copy and distribute Section V of the Open Space Plan (Interim Report - March 2002).

The commission received the copy of "Natural Resource-Based Planning for Watersheds-A Practical Starter Kit for Watershed Projects" that had been requested from the University of Connecticut Cooperative Extension System.

Members agreed to cancel the July 3rd meeting.

The Chairman, Susan Payne called the meeting to order at 7:10pm.

Approval of the minutes of the May 1st 2002 meeting of the Washington Conservation Commission; Joe Gitterman made the notion to approve the May 1st minutes, seconded by Linda Frank, passed unanimously.

Susan Payne discussed with the commission two items from the Inland Wetland minutes. The first one being an application for a dock on Lake Waramaug, she questioned jurisdiction and who's in charge with these issues. Secondly an application for a resident to pump water out of a brook to be used in an irrigation system. In regards to the irrigation system, Susan felt this is a major president to set and with the concern for water conservation becoming greater, could have an impact on the environment. She feels this is a conservation issue.

Subcommittee Reports:

Scenic Vistas/Roads: Joe Gitterman invited his subcommittee to this conservation meeting. Roger Cannavaro, Rebecca Bent and Walter Andrew were present. Rebecca Bent gave an overview of the Scenic Road Ordinance which included but is not limited to limits on widening and paving of roads, removal of stonewalls and mature trees. The designation of scenic roads can be found in the State Statues Section 7-149a. There are 40 towns in the state of Connecticut that have scenic road ordinances, many of them our neighbors. There are two ways to approach this ordinance. One being to adopt a scenic road ordinance naming specific roads with specific conditions. The second one would be delegating the power to the Planning Commission to adopt standards for scenic roads. The road may only be designated "scenic" if the majority of road frontage owners approve and may be rescinded in the same way. Roger Cannavaro questioned the purpose/goal of enacting a scenic road ordinance. Joe and Susan both agreed that the goal is to protect the "rural character" of the town. Roger feels that the reason for development is supply and demand, more people moving into town, traffic/speeding problems are increasing. With the "progress" that affects the town it becomes more and more complicated and he feels there comes a point when the town becomes "over regulated". He would not like to see more restrictions from a maintenance standpoint; "handcuffing" the town maintenance crews and selectmen. Many times upgrading roads is to help with maintenance/traffic issues. Roger also feels the town is straight forward and doesn't do things behind residents backs. Joe stated that if people with self interest came to power it could change the "rural character" and atmosphere of the town. Linda Frank inquired about getting information from towns that have a "scenic road ordinance". Walter Andrew stated that every town has different ways and guidelines. Walter felt that it was important to talk to the Planning Commission to see if they would be willing to take on this project. He went down this road several years ago and hit a stonewall with the Planning Commission. Joe Gitterman stated that this subcommittee will meet every Tuesday evening in June from 6:00 - 7:30pm. He will have an agenda for the subcommittee but this will not include designating roads for the "scenic road ordinance". Pam will send a reminder note to members with dates and time and also include Chapter 4 pages 40&41 on "protect scenic roads" from the workbook for the 2003 Plan of Conservation and Development.

Flora: Betsy has met with her group. Linda Potter gave comment on this meeting. Dirk Sabin would like to see a "Town Arboretum" and Betsy would like to see a booklet made available educating people and giving practical advise on invasive species. Susan Payne reported that the bill sponsored by Senator Roraback pertaining to "invasive species" passed through the Senate but was tabled in the House of Representatives.

Water resources: no report, Susan will pass information along to this group about the possibility of a group forming in Bantam concerning water issues.

Greenway Report: All members received copies of the minutes from the May 6th meeting of the Greenway Committee. Linda Potter was present at that meeting. Susan Payne has changed the monthly meeting day to the first Tuesday of each month, the next meeting being June 4th at 4:30pm in the Land Use Room.

Open Space Report: The open space inventory subcommittee is done with it's work for now. Patti Doran has completed a narrative to go with the map of suggested plan for open space. Pam will include a copy of this narrative in the next mailing for all Conservation members.

Planning Commission meeting 5/20: Susan Payne attended the special Planning Commission meeting held on May 20th. Susan felt that there was a resistance to talking to representatives involved with The Natural Resource Inventory Report, the Open Space Inventory Subcommittee and Greenway. No input from these groups was sought for Chapter 4 of the workbook which deals with Conservation Strategies. Susan felt that the opinions stated were Glen Chalder's and not the townspeople. Joe suggested that perhaps the process did not include what is already established. Susan Payne will speak with George Bender, Chairman of the Planning Commission and get an explanation of the process. Susan and members of the Conservation Commission were hoping for the opportunity to speak with Mr. Chalder.

Canoe Brook Project: Joe Gitterman gave

information concerning the stone work at the Carter residence on Walker Brook Road to Linda Frank.

Samson Driveway Project: Joe Gitterman states that the pillars have been removed and there are bulldozers working. Joe will keep us up to date on developments. The commission will work on a list for suggested replanting.
